    KNBT TERMS & CONDITIONS AGREEMENT
    FOR KNBT ONLINE & KNBT ONLINE BILL PAY

    This Agreement explains the Terms and Conditions governing the KNBT OnLine Banking services, including a link to the Electronic Funds Transfer Disclosure. Please read all documentation carefully. You may want to print this documentation for further reference.

    This Agreement between you and Keystone Nazareth Bank & Trust (KNBT) contains the terms and conditions governing KNBT OnLine Banking, hereafter referred to as "KNBT OnLine". These terms apply whenever you use KNBT OnLine Banking to conduct transactions or access an account. The words "we", "our", "Bank" and "us" refer to Keystone Nazareth Bank & Trust (KNBT). The words "you" and "your" refer to each person or business entity that maintains an account accessible through KNBT OnLine Banking services.

    The terms and conditions in this Agreement are in addition to any deposit account agreement or other agreement you have with us relating to your deposit accounts, including any disclosures made pursuant to applicable laws and regulations governing such agreements (together, the "Deposit Agreements"). When you use KNBT OnLine and/or KNBT OnLine Bill Pay or you permit any other person or other entity to use KNBT OnLine and/or KNBT OnLine Bill Pay, you agree to the terms and conditions we have set out in this agreement and any instructional material, which we provide you regarding our OnLine services. Your use of the services may be made by use of certain numbers, codes, marks, signs, public keys or other means of establishing your identity and acceptance of the electronic communications which are acceptable to us. All electronic communications that meet these requirements will be deemed to be valid and authentic and you intend and agree that those electronic communications will be given the same legal effect as written and signed paper communications. You agree that electronic copies of communications are valid and you will not contest the validity of the originals or copies, absent proof of altered data or tampering.


    ELIGIBILITY

    You must have at least one eligible deposit or loan account or one non-personal deposit account with us. Eligible accounts include savings accounts, checking accounts, money market accounts, certificates of deposit, line of credit accounts, loan accounts, and individual retirement accounts. A personal or non-personal account that requires two or more signatures to make withdrawals, transfers or transactions may not be designated as an eligible account. You will not have access to passbook accounts online.


    EQUIPMENT AND SOFTWARE

    To access KNBT OnLine Banking, you will need a PC and secure Internet browser.

    All browsers accessing secure pages within our website must support 128-bit encryption.
    To determine if your browser supports 128-bit encryption, click on "Help" in the toolbar of your Internet browser and click on "About [browser name]". A pop-up box or window will display.

    • For Internet Explorer - Next to "Cipher strength" you should see "128-bit".
    • For Netscape – the following text should appear: “This version supports high-grade (128-bit) security with RSA Public Key Cryptography”.
    • For Netscape versions earlier than 6, the following text should appear: “This version supports International security”.

    If your browser does not support 128-bit encryption, you will need to upgrade to a browser that does in order to continue to access secure pages of the website.

    KNBT is not responsible or liable for the performance or operation of the equipment, hardware, software, Internet provider, Internet browser, or any part of them. We are not responsible for any error or failures from any malfunction of your Computer or any software, and we are not responsible for any computer virus or related problems that may be associated with the use of an online system. We may, at our discretion and without prior notification to you, enter into an agreement to have another third party provide online services.


    USAGE OF PERSONAL FINANCIAL MANAGER (PFM) SOFTWARE INTUIT QUICKEN AND MICROSOFT MONEY

    To access your KNBT transactions from a checking or savings account via a PFM software application, such as Intuit Quicken or Microsoft Money, you must meet the equipment and technical requirements (noted above), and you must purchase your own copy of the PFM software.

    In order to import your KNBT account transactions into the PFM software (known as Direct Connect), you will be required to use your tax identification number for the User ID and to apply for a PFM Password. It is recommended that the PFM Password be different from your KNBT OnLine Banking Password to protect your banking information. The PFM Registration form will be accessible when adding your KNBT accounts to your PFM software. If you need assistance during this registration, please contact the KNBT Customer Service Center at 1-800-996-2062 Monday through Friday from 7 AM to 7 PM or Saturday from 8 AM to 2 PM.

    Should you choose to not register for a PFM Password, exporting KNBT account transactions into Intuit Quicken and Microsoft Money (known as Web Connect) is also available using the download formats available within KNBT OnLine Banking. Download formats may change periodically based on the software version changes of PFM manufacturers.

    KNBT does not provide service or support for Intuit Quicken or Microsoft Money software. For assistance with these products, please contact the software manufacturer directly.


    ENROLLMENT FOR KNBT ONLINE

    Your privacy and security are very important to us. To enroll, you will need the information listed below. This information is personal to you, but will be verified when your application is reviewed against our files. In addition, you will receive a notice, mailed to your address of record, as an added security measure to confirm your KNBT OnLine Banking enrollment intentions.

    Application Information Requested:

    • Name
    • Social Security Number
    • Date of Birth
    • Driver's License Number
    • Mother's Maiden Name
    • Address
    • Home Phone Number
    • Email Address
    • Amount of Last Deposit
    • Initial Password
    • Alternate Validation Information (Challenge Questions)

    ACCOUNT ACCESS

    Once your KNBT OnLine Banking application is accepted, you can:

    • Obtain account balances and transaction information about your eligible accounts.
    • Transfer funds between your eligible accounts.
    • View copies of checks online.
    • Place stop payments on checks from your eligible KNBT Checking or Money Market Accounts.
    • If you elect Bill Payment, you can make bill payments from an eligible KNBT Checking Account to selected Billers located within the United States.
    • Receive your monthly statement online via E-Statements.

    E-STATEMENTS

    • ELIGIBILITY FOR KNBT ONLINE E-STATEMENTS: KNBT's FREE Online E-Statement feature is available for existing KNBT OnLine Banking customers who wish to receive their monthly KNBT Checking or Money Market Account statement(s) electronically, in lieu of receiving paper statements via US mail. This service does not apply for Statement Savings customers. However, customers who receive a combined statement for their Checking and Statement Savings Accounts are eligible to receive E-Statements. If you have any questions about this feature, please call KNBT's Customer Service at 1-800-996-2062, Monday - Friday from 7:00 AM - 7:00 PM and Saturday from 8:00 AM - 2:00 PM.

    • KNBT ONLINE E-STATEMENT AGREEMENT: By clicking the "Accept" button, the owner(s) of this account agree to accept your monthly KNBT Checking Account statement(s), KNBT Money Market statement(s), or combined KNBT Checking and Statement Savings statement electronically via your KNBT OnLine Banking service. You acknowledge that an E-Statement will be generated for each KNBT Checking or Money Market Account you maintain and that you will no longer receive paper statements via US mail.

    • Method of Delivery: For new users, once you click on the "Accept" button, you will be directed immediately to the E-Statement page. Please note - your first E-Statement will not be available until the next statement cycle. An email notification will be sent to the email address that KNBT has on record for your account to inform you when your monthly E-Statement is available for viewing. You accept responsibility for ensuring that your email address is valid and current. KNBT will not be responsible for any incorrect or invalid email addresses that are received. To verify or change the email address that is currently on record for your KNBT OnLine Banking account, please click the User Options link and then select Email Address.

    • System Requirements: A secure Internet browser is required, such as Microsoft Internet Explorer or Netscape. Your online E-Statement will be posted in the form of a PDF (Portable Document Format) file, which can be viewed, printed or downloaded using Adobe Acrobat Reader software. If you do not have Adobe Acrobat Reader, a free download is available from the Adobe website.

    • Transaction History: Your E-Statements will include detailed account balance and transaction history for your KNBT Checking or Money Market Account (and, if applicable, your Statement Savings Account on combined statements only). An 18-month history will eventually become available as your transactions accumulate. We encourage you to download and/or print a copy of your E-Statements for your records.

      If you elect to receive your statement in an electronic format via KNBT OnLine Banking, you are still responsible for careful and prompt examination of the statement and the timely reporting of any unauthorized transactions. You agree to carefully review and reconcile your statement within 14 days of receipt, and you understand that if you fail to do so, you may lose certain legal rights. You agree to notify us if you change your address, email address, and/or contact telephone information.

    • Right to Withdraw Consent:
      You have the right to cancel your E-Statement service at any time and request to resume delivery of paper statements via US mail. Send us a secured email at https://www.knbt.com/Forms/OnlineForm.cgi?form=Feed_Back or visit your local KNBT branch location to request a withdrawal consent form. There are no fees or account restrictions for choosing to withdraw your consent to receive E-Statements. Before you click the "Accept" button, please print and retain a copy of this Agreement for your records.

    SECURITY

    During your enrollment for KNBT OnLine, you are required to select a User ID, Password and Challenge Questions to be used to validate your identity when logging into KNBT OnLine. You agree that the use of a User ID, Password and Challenge Questions is a commercially reasonable security procedure to verify the authenticity of any instruction, transfer, payment order or other transaction relating to any account of yours ("Transaction"), delivered to us via computer. You authorize us to act upon and you agree to be bound by, any transaction, whether or not authorized, issued in your name and accepted by us in compliance with this security procedure without further verification or inquiry. You acknowledge that this security procedure is not designed to detect errors in your payment instructions.

    You may change your Password at any time. You agree not to give or make available your password or other means to access your account to any unauthorized individuals. If you permit other persons access to your Password or other means to access your account, you are responsible for any transactions they authorize.

    Your Password or access to KNBT OnLine services may be revoked or canceled by us at any time without giving you prior notice to assist us in maintaining the security of your accounts. The Password is used to identify you as an authorized user of KNBT OnLine services, and we are entitled to act on any instructions we receive under your Password. You therefore agree to notify us immediately if the secrecy of your Password is compromised and you also agree not to reveal your Password to any person not authorized by you to use your KNBT OnLine services. If you believe that the secrecy of your Password has been compromised, you should call us immediately at 1-800-996-2062 (toll free).

    Account Aggregators/Consolidation Sites/Screen Scrapers are Internet sites that provide the ability to collect on one integrated website key information about you, such as bank balances. You will be asked to provide personal finance information, such as your User ID and Password for KNBT OnLine.

    • YOU SHOULD NEVER PROVIDE THIS INFORMATION TO A SITE THAT YOU DO NOT RECOGNIZE AND FULLY TRUST.

    • WE ARE NOT LIABLE FOR ANY TRANSACTIONS THAT YOU INITIATE THROUGH SUCH A SITE OR THAT ARE INITIATED THROUGH SUCH A SITE USING YOUR PASSWORD. All transactions initiated, using access information you provide, are considered to be authorized by you, whether or not you were aware of the specific transaction.

    These features of KNBT are limited by and subject to the terms and conditions described below:

    • Your ability to transfer funds between certain accounts is limited by federal law, as stated in the Deposit Agreement. For example, you can make no more that six (6) transfers from a savings or money market account during each statement cycle, and, in the case of a money market account, no more that three (3) of such transactions may be made by third party check. Transfers and bill payments made using both KNBT OnLine and the other transfer methods described in the Deposit Agreements are counted against the permissible number of transfers.

    • The Bank will not immediately receive E-mail that you send. Therefore, you should not rely on E-mail if you need to communicate with the Bank immediately. For example, if you need to put a stop payment on a check, to report a lost or stolen card, or to report an unauthorized transaction from one of your accounts you should contact the Bank immediately. The Bank will not take actions based on your E-mail requests until the Bank actually receives your message and has a reasonable opportunity to act.

    SPECIAL BUSINESS CUSTOMER INSTRUCTIONS

    You are responsible for all transactions relating to your business accounts and consumer accounts made using your Password or the Password of any authorized signer, whether or not such transactions are authorized by you or such signer. You agree to indemnify and hold us harmless from any loss suffered or liability incurred by us in, or arising from, our execution of any transaction relating to your business accounts and consumer accounts linked thereto, provided such Password is provided to us with the transaction. You agree not to give or make available your password or other means to access your business account to any unauthorized individuals. If you permit other persons access to your Password or other means to access your account, you are responsible for any transactions they authorize.


    KNBT ONLINE BILL PAY

    KNBT OnLine Bill Pay requires an additional enrollment application that is accessed within KNBT OnLine. Select the Bill Pay icon and instructions will appear. After your enrollment is submitted, you will receive:

    • A confirmation email that your enrollment application was received
    • A confirmation email that the service is available for use

    To subscribe to Bill Pay, you must have at least one eligible KNBT Checking Account in good standing. If you subscribe to this service, you may use Bill Pay to make payments from your designated KNBT Checking Account(s), hereafter referred to as “Payment Account”. An account that requires two or more signatures to make withdrawals may not be designated as a Payment Account.

    To pay bills using Bill Pay, you must use your computer to authorize a payment from a Payment Account. After your instruction is received, payment will be made either by transferring funds electronically from a Payment Account to the person or business you are paying, hereafter referred to as ”Biller”, or by preparing a check from a Payment Account payable to the Biller and sending the check to the Biller.

    Using Bill Pay, you can only pay Billers with United States addresses. While most payments can be made using Bill Pay, the Bill Pay service reserves the right to refuse to pay certain Billers. You agree not to use KNBT OnLine Banking to pay Billers to whom you are obligated for tax payments or payments made pursuant to court orders or fines.

    Bill payments are processed on business days, which include Monday - Friday. No payments are processed on Saturdays, Sundays or Federal holidays.

    You may use Bill Pay to authorize a single, one-time payment or automatic recurring payments to pay your recurring bills. Recurring payments must be for the same amount each month and will typically be paid on the same calendar day of each month. If the date of a scheduled recurring payment falls on a Saturday or Sunday, the bill payment will be processed on the day before -Friday. If the date of a scheduled recurring payment falls on a holiday, the bill payment will be processed on the business day prior to the holiday date.

    When you have entered and transmitted a payment instruction, you authorize the Bank to reduce the Payment Account accordingly. If there are insufficient funds in the Payment Account to make payments you have authorized, the Bank may either refuse or pay the item or it may make the payment and thereby overdraw the Payment Account. In either event, you are responsible for any non-sufficient funds (NSF) or overdraft charge the Bank may impose, as stated in the Deposit Agreements. The Bank reserves the right to refuse to honor payment requests that reasonably appear to the Bank to be fraudulent or erroneous.

    You may make individual bill payments, of up to $99,999 each, in KNBT OnLine or the amount of the available balance in your account, whichever is less. For security reasons, we reserve the right to limit the frequency and dollar amount of transactions from your accounts.


    SCHEDULING PAYMENTS

    When using Bill Pay, you should enter and transmit your bill payment instructions at least four (4) business days before a bill is due. It is your responsibility to authorize your bill payments in such a manner that your bills may be paid on time. You are responsible for any late payment or finance charges that may be imposed as a result of your failure to transmit payment instructions at least four (4) business days in advance. Expedited payment options may be available with specific Billers.

    "Due Date" is the date reflected on your Biller statement for which the payment is due; it is not the late date or grace period.


    E-BILL DELIVERY AND PRESENTMENT

    You may select to receive your Biller statements electronically through the Bill Pay service. Your activation of the electronic bill feature for a Biller shall be deemed by the Bill Pay service to be your authorization for the Bill Pay service to obtain bill data from the Biller on your behalf. For some Billers, you will be asked for additional information to make your bill available electronically. Each electronic Biller reserves the right to accept or deny your request to receive electronic bills.

    You are responsible to update or change your personal information such as, but not limited to, name, address, phone numbers and e-mail addresses, with the electronic Biller. You may cancel electronic bill presentment at any time. The timeframe for cancellation of your electronic bill presentment may vary from Biller to Biller.

    You agree to hold the Bank and the Bill Pay service harmless should the Biller fail to deliver your statement(s). You are responsible for ensuring timely payment of all bills. The Bank and Bill Pay service is not responsible for the accuracy of your electronic bill(s), only the presentment of the information received from the Biller. Any discrepancies, disputes or requests for copies of previously delivered bills must be addressed with the Biller directly.


    CANCELING FUTURE BILL PAYMENTS OR TRANSFERS

    If you have scheduled an instruction to make a future bill payment or transfer, you may cancel the bill payment or transfer by logging into KNBT OnLine four days prior to the business day on which the payment or transfer is to be made.


    CANCELING FUTURE RECURRING BILL PAYMENTS OR TRANSFERS

    If you have scheduled an instruction to make future recurring bill payments or transfers, you may cancel the entire transaction or skip the next scheduled bill payment or transfer prior by logging on to KNBT OnLine four days prior to the business day on which the payment or transfer is scheduled to be made.


    STOP PAYMENTS

    The ability to process a stop payment request will depend on the payment method and whether or not a check has cleared. The Bill Pay service may not have reasonable opportunity to act on a stop payment request after a payment is processing.

    If you wish to stop payment on a Bill Pay payment you previously authorized, you should consult you applicable Deposit Agreement and contact KNBT Customer Service. Placing a stop payment on your KNBT account against an authorized Bill Pay payment may not stop the payment from being processed on your account at the Biller.

    The charge for each stop payment request will be the current charge for such service as set out in the applicable fee schedule.


    INACTIVITY

    If you do not log on or have outstanding scheduled bill payments or transfers through KNBT OnLine Banking or KNBT OnLine Bill Pay for 180 days, we may cancel your Service without further notice.


    FEES FOR KNBT ONLINE BANKING & KNBT ONLINE BILL PAY

    The charge for KNBT OnLine Banking and KNBT OnLIne Bill Pay will be the current charge for such service as set out in the applicable fee schedule.


    ALTERATIONS AND AMENDMENTS WITH REGARD TO THIS AGREEMENT

    These Terms and Conditions are the legal binding Agreement between you and KNBT. You will be agreeing to the current provisions of these Terms and Conditions (including any new services made available) each time you access KNBT OnLine. These Terms and Conditions may have been altered or amended from the last time you accessed KNBT OnLine. Please be sure to read it each time you access KNBT OnLine to be certain you still agree with its provisions. Your use of KNBT OnLine after any changes to these Terms and Conditions will constitute your agreement to such change(s).


    ERROR RESOLUTION

    In case of errors or questions about your KNBT OnLine transactions, please call the Customer Service telephone number at 1-800-996-2062 (toll free).

  • Note For Commercial Accounts: If you are a commercial account holder and you have a question about your statement or believe an error has occurred which could not be resolved be calling the Customer Service telephone number, please contact the Bank. The error resolution procedures contained in the remainder of this section do not apply to commercial accounts.

  • CONSUMER ACCOUNTS
    (The following applies to Consumer Accounts only.)

    If you think your statement is wrong or if you need more information about a transaction listed on the statement, the Bank must hear from you no later than 60 days after it sends or delivers to you the FIRST statement on which the problem or error appeared. If you requested more information about a problem or error, the Bank must hear from you within 60 days after it sends or delivers that information to you.

    • Tell us your name and account number(s).
    • Describe the suspected error or the nature of the problem, or describe what information you need.
    • Tell us the dollar amount of the suspected error.

    If you tell the Bank orally, we may require that you send in your complaint or question in writing within 10 business days. The Bank will tell you the results of its investigation within 10 business days after we hear from you and will correct any error promptly. If the Bank needs more time, however, it may take up to 45 days to investigate your complaint or question, in which case, the Bank will re-credit your account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes the Bank to complete its investigation. If the Bank asks you to put your complaint or question in writing and does not receive it within 10 business days, the Bank may not re-credit your account.

    If the Bank decides that there was no error, it will send you a written explanation within 3 business days after it finishes its investigation. You may ask for copies of the documents that the Bank used in its investigation.

    TERMINATION

    To terminate the KNBT OnLine service, please send written authorization at the address shown above or visit a Keystone Nazareth Bank & Trust branch. You authorize us to complete fund transfers until we have had a reasonable opportunity to act upon your termination notice.

    We may terminate this agreement and your use of the online banking services at any time without cause or prior notice.


    NOTICE OF YOUR RIGHTS AND LIABILITIES

    Except as otherwise provided in this Agreement or otherwise expressly provided by applicable law or regulation, you agree that neither we nor any party that provides Internet access or provides equipment used to access the KNBT OnLine Banking services or any agent, independent contractor, or subcontractor of any of the foregoing will be liable for any loss, injury, or damage including without limitation, direct, indirect, incidental, special, consequential, or punitive damages, whether under a contract, tort or any other theory of liability, arising in any way of the installation, use or maintenance of the KNBT OnLine Banking services or of the Internet service provider used to access the KNBT OnLine Banking services, or of the equipment used to access the KNBT OnLine Banking services including, without limitation, any loss, injury, or damage relating to any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus, line failure or unauthorized interception or access to your communications with us, even if we or the Service Providers are aware of the possibility of such event.


    LIMITATION OF LIABILITY

    Except as otherwise provided in this Agreement or by law, we are not responsible for any loss, injury, or damage, whether direct, indirect, special or consequential, caused by KNBT OnLine Banking services or the use thereof or arising in any way out of the installation, operation, or maintenance of your PC equipment.


    ELECTRONIC FUNDS TRANSFER (REGULATION E) DISCLOSURE STATEMENT

    As a consumer who uses electronic fund transfers (EFT) services, you have certain rights and responsibilities, which are defined by the Electronic Fund Transfer Act (15 U.S.C. 1693, Et seq.) and Regulation E of the Federal Reserve Board. Click here for Regulation E details.

    When you enroll to use KNBT OnLine Banking or KNBT OnLine Bill Pay via our online registration form, you will have the opportunity to review the above Terms and Conditions for these services. Before you can access account information, you will need to click on the "Accept" button to acknowledge that you have read and understand these Terms & Conditions and the Electronic Funds Transfer Disclosure, and you agree to be bound by their terms and any future amendments, which may be made from time to time.
